Data protection is of a particularly high priority for us. We collect personal information from you only in accordance with the legal requirements (GDPR, TA 2003). By means of this data protection declaration, our enterprise would like to inform you about the most important issues of data processing in line with our website as well as our other business operations.

The processing of personal data, such as the name, address, e-mail address, or telephone number of a data subject shall always be in line with the General Data Protection Regulation (GDPR), and in accordance with the country-specific data protection regulations applicable to the amcoss GmbH (Telecommunications Act 2003). By means of this data protection declaration, our enterprise (controller) would like to inform the general public of the nature, scope, and purpose of the personal data we collect, use and process. Furthermore, data subjects are informed, by means of this data protection declaration, of the rights to which they are entitled.

Our website may be used without entering personal information. Different rules may apply to certain services on our site, however, and are explained separately below. Information is considered personal if it can be associated exclusively to a specific natural person.

Please be aware that data transfer via the internet is subject to security risks and, therefore, complete protection against third-party access to transferred data cannot be ensured.

Cookies

Our website makes use of so-called cookies in order to recognize repeat use of our website by the same user/internet connection subscriber. Cookies are small text files that your internet browser downloads and stores on your computer. They are used to improve our website and services.
To an extent, however, these cookies also pass along information used to automatically recognize you. Recognition occurs through an IP address saved to the cookies. The information thereby obtained is used to improve our services and to expedite your access to the website.

Purpose of Registering

We offer you the opportunity to sign up with personal data for our website in the news area (news-alert). The information entered when signing up, as shown in the registration form (email-address) is collected and stored solely for use by our website. When signing up for our website, we also store your IP address and the date and time you registered. This serves to protect us in the event a third party improperly and without your knowledge makes use of your data to sign up for our site. None of this information is transferred to third parties. Nor is any of this information matched to any information that may be collected by other components of our website.

As soon as you have signed up to the news-alert we will send you a confirmation e-mail with a link for the affirmation of the registration. After confirmation of your registration you will receive a message via e-mail each time when we publish a new post in the news area of our website. You can retrieve the new information on our website if you wish so.
You can cancel the subscription at any time. Send your cancellation to the following e-mail address: office@amcoss.com. Then, we will delete your data in connection with the news-alert.

Contacting Us

On our website we offer you the opportunity to contact us, either by email and/or by using a contact form. In such event, information provided voluntarily by the user is stored for the purpose of facilitating communications with the user. No data is transferred to third parties. Nor is any of this information matched to any information that may be collected by other components of our website.

Use of Google Analytics with anonymization

Our website uses Google Analytics, a web analysis service from Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as “Google“. Google Analytics employs so-called “cookies“ (text files that are stored to your computer) in order to facilitate an analysis of your use of the site.
The information generated by these cookies, such as time, place and frequency of your visits to our site, including your IP address, is transmitted to Google’s location in the US and stored there.

You can avoid this by means of a corresponding adjustment of the web browser used and thus permanently deny the setting of cookies. Such an adjustment to the Internet browser used would also prevent Google Analytics from setting a cookie on your information technology system. In addition, cookies already in use by Google Analytics may be deleted at any time via a web browser or other software programs.

Data processing is carried out based on the legal regulations of § 96 (3) TA and article 6 (1) lit. a (agreement) and/or f (legitimate interest) of GDPR.
Our concern in the sense of GDPR ((legitimate interest) is the improvement of our offer and our website.

We use Google Analytics with an IP anonymization feature on our website. In doing so, Google abbreviates and thereby anonymizes your IP address before transferring it from member states of the European Union or signatory states to the Agreement on the European Economic Area. Thus, only a rough localisation is possible.

Google will use this information to evaluate your usage of our site, to compile reports on website activity for us, and to provide other services related to website- and internet usage. Google may also transfer this information to third parties if this is required by law or to the extent this data is processed by third parties on Google´s behalf.

Google states that it will in never associate your IP address with other data held by Google. You can prevent cookies from being installed by adjusting the settings on your browser software accordingly. You should be aware, however, that by doing so you may not be able to make full use of all the functions of our website.

Google also offers a disabling option for the most common browsers, thus providing you with greater control over the data which is collected and processed by Google and you can anticipate or controvert the collection, usage and processing of these data. If you enable this option, no information regarding your website visit is transmitted to Google Analytics. However, the activation does not prevent the transmission of information to us or to any other web analytics services we may use. The installation of this browser add-on is assessed as an objection by Google.

Google Analytics Data Processing Amendment

Use of YouTube components with enhanced data protection mode

On our website we use components (videos) of YouTube, LLC 901 Cherry Ave., 94066 San Bruno, CA, USA, a company belonging to Google Inc., Amphitheatre Parkway, Mountain View, CA 94043, USA.

To this end, we use the “ – enhanced data protection mode – ” option provided by YouTube.

When you display a page that has an embedded video, a connection will be made to the YouTube server and the content will appear on the website via a communication to your browser.

According to the information provided by YouTube, in “ – enhanced data protection mode -”, data is only transferred to the YouTube server, in particular which of our websites you have visited, if you watch the video. If you are logged onto YouTube at the same time, this information will be matched to your YouTube member account. You can prevent this from happening by logging out of your member account before visiting our website.

Publication of vacancy announcements / job applications

We electronically collect and process your application data for the purpose of completing the application process. If your application results in the conclusion of an employment contract, the data collected from you may be stored in your personnel file for purposes of normal organizational and administrative processes in compliance with appropriate legal requirements.

Upon rejection of your application, data you have provided is automatically deleted two months after notification of rejection. This does not apply in such instances where, due to legal requirements (such as the burden of proof obligation stipulated in the Equal Treatment Act) a longer storage period is necessitated or when you expressly agreed to have your data stored for a longer period in our database of prospective applicants.

Information/Cancellation/Deletion

You may contact us at no cost if you have questions relating to the collection, processing or use of your personal information, if you wish to request the correction, blocking or deletion of the same, or if you wish to cancel explicitly granted consent. Please note that you have the right to have incorrect data corrected or to have personal data deleted, where such claim is not barred by any legal obligation to retain this data.

Legal basis for the processing

Art. 6(1) lit. a GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, when processing operations are necessary for the supply of goods or to provide any other service, the processing is based on Article 6(1) lit. b GDPR. The same applies to such processing operations which are necessary for carrying out pre-contractual measures, for example in the case of inquiries concerning our products or services. Is our company subject to a legal obligation by which processing of personal data is required, such as for the fulfillment of tax obligations, the processing is based on Art. 6(1) lit. c GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or of another natural person. This would be the case, for example, if a visitor were injured in our company and his name, age, health insurance data or other vital information would have to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6(1) lit. d GDPR. Finally, processing operations could be based on Article 6(1) lit. f GDPR. This legal basis is used for processing operations which are not covered by any of the abovementioned legal grounds, if processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data. Such processing operations are particularly permissible because they have been specifically mentioned by the European legislator. He considered that a legitimate interest could be assumed if the data subject is a client of the controller (Recital 47 Sentence 2 GDPR).

The legitimate interests pursued by the controller or by a third party

Where the processing of personal data is based on Article 6(1) lit. f GDPR our legitimate interest is to carry out our business in favour of the well-being of all our employees and the shareholders.

Period for which the personal data will be stored

The criteria used to determine the period of storage of personal data is the respective statutory retention period. After expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfillment of the contract or the initiation of a contract.

We clarify that the provision of personal data is partly required by law (e.g. tax regulations) or can also result from contractual provisions (e.g. information on the contractual partner). Sometimes it may be necessary to conclude a contract that the data subject provides us with personal data, which must subsequently be processed by us. The data subject is, for example, obliged to provide us with personal data when our company signs a contract with him or her. The non-provision of the personal data would have the consequence that the contract with the data subject could not be concluded.

Existence of automated decision-making

As a responsible company, we do not use automatic decision-making or profiling.
